There are rumors that we will be around 5000 at the rally. Let's prove them wrong and bring at least 10,000 of our members. I am willing to share more funds for people who so far are not planning to attend, and to advertise and promote the rally as much as possible. Guys, we still have nearly 3 weeks, we can get to 10,000 and beyond! Let's work hard now to accomplish that! Please post your ideas here to make it more than 10,000. Just like telethons have a target donationn amount to be raised, we should have a minimum attendance target for the rally to achieve! but isnt this the reason for LC advertising? That is, if a USC or permanent resident applies he should be given preference over an immigrant. By that rationale I am not so sure it is illegal.
Also, many large companies, when applying for jobs on their websites, mandatorily require you to state your visa status. While self-identification (race, sex) is always optional and cannot be required (by law, there will alwyas be a staement that says submission of this info is voluntary). t

Though a committee vote will not be held until after a week-long congressional recess, likely March 27, committee members appeared ready to back the Kennedy-McCain bill.
"The votes are there," said Sen. Charles Grassley, R-Iowa.
Congress is working to pass a reform bill that includes enforcement, a policy on dealing with illegals already in the country and a guest-worker program pushed by President Bush.
Under the legislation, illegal aliens in the United States would obtain six-year nonimmigrant visas under which they could work in the country and travel outside the country. The aliens would have to pay a $1,000 fine and undergo background checks.
After six years, the aliens would be able to meet certain requirements and then apply for a green card, or permanent residency.
Besides voting on the bill after the recess, committee Chairman Arlen Specter, R-Pa., said the panel also would vote on a bill by Sens. John Cornyn, R-Texas, and Jon Kyl, R-Ariz., that would give illegal aliens up to five years to leave the U.S. After returning home, they could then apply to return, either as temporary workers or for permanent residency.
"Our intention is not to strand anyone outside the country," Kyl said, according to an AP report. But he asserted the McCain-Kennedy plan would give an illegal alien allowed to stay and work in the country a "huge advantage" over a person having to wait for years in his or her own country for a green card.
The McCain-Kennedy bill would start off with offering 400,000 of the new visas.
Two years ago, Bush proposed a guest-worker program that has been criticized by immigration-reform advocates as nothing more than an amnesty program for foreigners who entered the United States illegally.

I got my GC after 6 years of application and 10 years arrival. Initially the GC was not a goal, probably a mistake.Later on it felt like it was hampering my dreams. With the passage of some more time, realized that dreams were not really dependent on the GC, but it was a nice crutch. Getting the GC does bring about some stability brought about by the job flexibility, but the lack of one did not prevent me from changing jobs, marrying, having kids, buying a home, or searching for better opportunities. I really can't say, I lost a good opportunity because I did not have a GC, but I did use it as an excuse.
Nevertheless, not a look a gift horse in the mouth, the GC was a much awaited event and milestone. I am now officially an immigrant, and I did open a champagne bottle on that day and have a dinner out with the family.
- Any advice for everyone?
It is easy to give this, since it would no longer apply to me, nevertheless, I would advice one to plan one's life without the feeling of entitlement and the understanding that the GC in itself will not change your life by a whole lot(it will have a lot of impact for some, but on average, lives for most will go on) . You can bring UP TO 4 spouses on H4 visa. That's why it is called H4. Similarly on F2, you can only bring 2 spouses, Ah...students do not make that kind of money to support more than 2 spouses. USCIS thinks so much about us.

Two things I would like to mention here:
First, a possibilty of an RFE for your laetest Employment Verification only arises when certain red-flags are raised. Among them are:
1.) Address on file (which has changed after filing I-485) is in a different state from the place of employment. Now I am sure the officer knows that DC and Virginia/Maryland or NH and MA are different states but still they can be daily commuter workers sou could be spared.
I have seen more than a bunch of folks getting RFE's for this specific reason.
2.) Long time (upto the discretion of the CAO..but I feel it is more than 18 months) has passed since the I-485 has filed.
3.) Any other history of excessive job-hopping.
Please pitch in if you know any other substantive reason.
Second,
For the job description from the new employer: I would say put whatever the new employer says but make sure ...for sure to copy paste two related sentences from your old job desc. into the new one to be the first bullets in the description.
I had changed jobs using AC21, used EAD, moved to a different state (5-6 states apart, i.e not a daily commuter) had a slightly different job title. Oh I was so sure that I would get an RFE ...I made sure I sent the AC21 docs against the advise of my attorney (he wanted CIS to send the RFE, made no sense as that would have literally wasted time and my money ;))...and did all the things that I just said about the new EVL...and got the I-485 approved without any issues.
Go ahead and make the best of AC21!:)

Currently where I am working client willing to hire me as a fulltime employee with the same titile and giving me the supporting letter with the same job duties mentioned in my LC (I have added few more technologies it).
Even my attorney says the same, no need to inform CIS - when we get the RFE we will see.
Can you kindly let me know all the documents I need to gather and what I need to request from new employer in order to submit AC21 bunch to CIS.
Here are job discriptions with titles.
Old Employer.
Title: Computer Systems Analyst.
Analyze systems requirements, procedures & problems to automate process. Write description of user needs, program functions & steps to develop and modify systems. Other than that, you will find a lot of hatred from this forum as what you are doing is very much inflaming since you are cutting in line -- legally so -- but still, its cutting in line. So dont be surprised by that.

Applied for H1B. We already have the H1B approval notices. We also have EAD/AP. Still we got dragged into this.
The H1B sponsoring company is a large and famous Biopharma company with billions in market cap. AOS is also through the I-140 from that company.
Everything is way above board for us. Still we got stuck!

I understand that is not a reliable source of tracking approval pattern, however, this is the only tracker we have available and this gives us fairly good idea about USCIS processing.
Based on , there are about 1200 Approvals for EB-2 (Including ROW, India and China) since Oct01 2007.
However, there are only 450 approvals for EB-3 (Including ROW, India and China) sine Oct01'2007.
So howcome they ran out of EB3 numbers when there are very few approvals for this year. I was hoping they will run out of EB2 numbers instead.
Any insight on this?

I filed for my self, wife and two daughters I-485 and EAD with all documents but without I-140 recipt notice instead I enclosed evidences of the cashed check, INS online status print out and cover letter with reciept number.
My application reached on July 2 at 11:34am. No reciept yet. I called INS and representative explained my case will not be denied. If at all, INS will ask for the reciept notice.
I have my reciept notice for I-140 now.
At this point shall I wait or apply one more today with the reciept notice.

What was 245(i) amnesty?...just curious
Section 245(i) is a part of the INA. In 2001, this section was updated to allow people present illegally to submit a labor certification. This resulted in the DOL getting 6 years worth of applications in April 2001. These applications led to the establishment of the Backlog Elimination Centers and the PERM process. The applications filed 6 years ago are still being processed by the DOL.
Btw if you do not support DREAM ACT than you shouldn't be on this forum...
At this point I am neutral on the DREAM act. Before I can support the DREAM act you need to prove how it helps children of legal immigrants. I suspect there is more to your story than you are letting on. If you are 21 now, you would have been 19 in 2005 and well able to understand the consequences of becoming an illegal immigrant. As someone said the F1 was an option if you wanted to maintain legal status.
Section 245(i) is a part of the INA. In 2001, this section was updated to allow people present illegally to submit a labor certification. This resulted in the DOL getting 6 years worth of applications in April 2001. These applications led to the establishment of the Backlog Elimination Centers and the PERM process. The applications filed 6 years ago are still being processed by the DOL.

As our members get greencards, we are happy for them and wish them good luck for future. Please continue to support Immigrationvoice and visit this site to help others waiting in line. Not very many things have changed since getting GC but with the economy in turmoil at least I have a little peace of mind that if anything were to happen to my current job, the struggle for another job would be easier (hopefully). -
- What did you do on the day you received it?
Went with my wife to a Moe's
- How did the long wait upset your life?
It did not affect my life too much and it should not as I got my GC within 7 years of my coming to the US, while a lot of my borthers who have been to the US longer than I are still waiting. - How did immigrationvoice help you during this long wait?
IV was like panacea for all immigration related anxieties.- Would you like to continue your support to immigration voice and help others waiting?
Absolutely, thus coming back to IV.

Well coming from a person who had to wait relatively less time for GC, this might seem shallow, but I have followed one simple principle in life, perserverence. Also I have planned ahead for the next step before one reaches the finish line as it keeps you motivated to reach higher, become better. So let GC be the goal but not let it stop you from enjoying life.
First step after GC, go to SSN office and get your Social Security card renewed to the one which does not have the line "INS authorization required to work. ANd if you follow Murthy wait at least 6 months before leaving your GC sponsoring employer.
Once anyone received his greencard, please update the IV tracker too. We like to see how many members in IV are greencard holders and what is the current trend of approvals in our membership
