From Politico: House Speaker Nancy Pelosi wants to push for a vote during the lame-duck session on a bill that would legalize young, undocumented immigrants if they attend college or serve in the military, according to Democratic sources familiar with a leadership conference call Wednesday. Here is my situation . My visa status is H1b and i was laid off by a well-known software company and my termination date was 30th Oct 2009 .
I approached a software consultancy and they filed a LCA petition on 3rd Nov 2009 and applied for H1b transfer on 10th Nov 2009 . They received the EAC petition number on 3rd December 2009 . Meanwhile they kept trying a project for me . I have following queries
1. As i am not getting any salary from 1st Nov 2009 , what is my legal status ? Am i out of status and till what time i could stay here ? What could be effects if i stay here for long without project and salary?
2. Am i entitled to get any salary from current company (software consultancy) ? If yes , when shall they start paying me ?Can they really force me legally to stay here without salary as they might have an excuse that H1 is still not transferred and i am not their employee right now ? I want to add one point here their offer letter states that starting date would be 1st Nov subject to legal H1 transfer.
3. What are my legal rights if software consultancy company forces me to stay here without any pay stub ? Please tell me my options.

I have an approved 140 and applied for 485 got by EAD and done my FP, however recently i got married and i want to know how do i add my wife to my current 485 status ??
My employer lawyer says ; 485 dates should be current to add my wife ?? is that true ??

I got my visa H1B from employer X in the year 2003 and travelled to US in jan 2004 immigration officials denied my port of entry saying employer X is non-existent and cancelled my visa and told to with draw my application and they have written 212(a)(c)(i)(i) on my passport.I went back to my home country and worked over there for 3 yrs. After sometime i got an offer from some employer Y,they have filed for my H1B and approved.
When i went for visa to US Consulate visa officer told me that am ineligible for the H1B visa. I have explained them what exactly happened in 2004.
VisaOfficer has asked to appeal for waiver using the form I-601,after my appeal to the USCIS, consulate has given the visa.I came to US in 2007 and working for same employer B .I applied for extension under the same employer B,got an RFE asking to submit aggrement b/w the client and the vendor,the requested documents are sent. After that USCIS sent NOID(Notice of Intent to Deny),gave the reason as :
In January 2004 the beneficiay applied for admission as an H1 B Worker for company X.Under oath the beneficiary stated he never signed a contract with the petitioning company X,the petition company was found not to exist. Therefore, the beneficiary was found inadmissible under 212(A)(6)(C)(I) and 212(A)(7)(A)(I)(I) and permanently ineligible for the H1 Classification.
USCIS has again came back with the same issue of my previous H1 B.
I have been in US from 2007 June with employer Y ,after going through all the process in the year 2007 USCIS has issued my visa.
Please advice me on this, any help fully appreciated.

I have just gone thru March recording of IV lawyer call and the below caught my attention. Ms Susan mentioned that any company name change after I140 approval has to refile I 140. I am utterly confused as that particular scenario affect me and i would like to know what best course of action i can take at this point.
I filed LC and I 140 with company A
My I 140 got approved
Before i filed my I 485 my company changed its name
I asked my attorney at that time if we need to take any special action
Attorney said they can just add an amendment while applying for I 485 about name change and apply with approved I 140, which is with old company name.
I and my wife work on EAD for past 3 years and i am still employed with same company. I wonder which one of above attorney is correct and what i should do.
Does the fact that my I485 is pending for more than 180 days after approval of my I 140 will come to rescue in case of question about company name change (AC21)

I hadn't noticed the little white spot - you are quite right and I'll zap it.
This version of the image isn't super sharp. This is the first one I've tried to upload to this forum and I had some trouble doing it. It kept telling me that my file size was too large so I wound up having to reduce the quality a fair bit to get it uploaded within the file size allowed.
It is actually hardly cropped at all. The original is quite a bit sharper than this but then again the camera was not a DSLR but the sony F707 which is one of the first 5 megapixel cameras. I recently upgraded to an 8mp Nikon 8800 but am very disappointed with the resolution of that camera in the telephoto range. I see a Canon DSLR in the near future.

Hi,
I have AOS and was recently laid off from my job. As I haven't found another job by the removal-from-payroll deadline, my H1B will expire. My question is, once I get my EAD, can I apply for a new H1B. The motivation is that I can bring a spouse over on a dependant visa only on H1B but not on AOS. How should I work this out?

Iam on L2 and working on my EAD which is expiring on april 29 th 2011.
I have applied for H1 in the 2010 quota but due to my employers mistake i got a rejection on that.
we are trying to reappeal to USCIS but iam not sure if its going to work.
Suppose i have a project and apply again for 2011 quota , can i still continue working even if my EAD expires.
They say that we actually move to H1 on October , so if i apply before end of April through premium processing and get an approval notice before October can i continue working or start work right away or do i have to wait till October.
Is there a possibility to start working immediately as soon as my H1 gets approved or do we have to wait until October in any case.

Hi,
Can anyone share the experience of H1 Visa stamping in Hyderabad. As per their web site they need quite a lot of documentation. Not sure if such doecumentation is required for visa revalidation (same category - H1) as well.

I like the colors, and the silhouetted person. Personally, I think cropping out a lot of the top (roughly the upper 1/2 of the picture) would make it more interesting. This would also give it a panorama-like appearance.

That little sucker looks to be one heck of a feature packed little camera. If you did not think about FF and pro stuff this would make the consumer camera one real tough decision! Nice little camera!
