As a H1B holder, can I start a new company and volunteer for it while I am holding a full-time job for the company that sponsors me the visa? I am expecting the new company to gain a profit, of course.:)

I actually spoke to my candidate and he will now be using the premium service for his H1B and then resigning since he can transfer.
Now, the question I have is how expensive is it to transfer the H1B and can the candidate travel during the transfer?

My wife is primary applicant for 485. We both are continuing on H1 and have EADs. Our Son came as my dependent.
Our company is brought by another company and countdown has started for our group. Looking at present market conditions I may have to use EAD. Will try to transfer H1 but just in case ...

I travelled on mine 3 months after it was issued ( delay in getting wife's visa). I was questioned at the airport about the delay in travel. Explained the delay and got entry. It may be possible that they may like to speak to your immediate boss (carry his office and cell numbers)

DMV has accepted EAD with Last name as LNU though the passport do not have any surname . They have issue DL with LNU. Life is moving on.
When I checked with My lawyer about "How to correct at 485 filing" . My lawyer belongs to one of the big corporate lawyer firm (USABAL)
1) correct the name at password . we can send the passport for name split .
if you do not have this isse then ignore
2) Wait for GC CARD
3) File some kind of form to get the replacement card --(we need to attach some proof with form) . Lawyer is going to file for us.
For now just waiting ...

thats what I did when I moved back to company A. My lawyer suggested as long as company A did not cancel your H1 approval you are good to go!!..Hope this helps. Good luck.

Cases will be considered accepted on the date that USCIS takes possession of a properly filed petition with the correct fee; not the date that the petition is postmarked.

hi, My Lawyer says that texas SWA gave him a figure of $ 105,000 annual salary as a prevailing wage for 5 years experience java,j2ee guy. After discussing with people who have already filed in EB2 i get the feeling that this is too much amount and the wage requirement is somewhere between 80-85,0000. My lawyer is trying to downgrade me to EB3. I want to contest his claim but I am not sure what mistake he has made. What questions should I ask him to figure it out. Any help would be great.

I currently work for a consulting company who is sponsoring my GC.Our client has offered me a full time position and I was planning to use AC21 to switch over but better sense prevailed over me to continue with my current employer to avoid any issues in GC processing.Now my client is not willing to extend my contract.Given the current job market, I think it might take atleast a month or two for my employer to find me another project.
Just in case my I485 gets approved, can anyone please let me know if it is ok to be without pay (employer will not pay between projects) after the GC gets approved?Please advise.

I-140 doesn't belong to the employee. Period.
Then ownership of I-140 needs to change as well. Maybe this is something we could all work in the long term.... and not an immediate goal at this time. Of'course this will need help from everybody on the forums. Something like this is sure to help all of us.

Hello Friends,
I have utilized AC-21 and moved onto another employer and I will be using my EAD. I have an I-94, from the I-797 of my previous employer, which expires in May 2008.
The question I have is if we have utilized AC-21 can we still live here in US past the I-94 date? Will the stay be considered legal? I ask because as far as I know when a person is on H1B he can not afford to go past the I-94 validity date, does the same apply with an AOS applicant?

Please update your case if you have applied on July 2nd at NSC and your case got transferred to TSC later..
