We have been calling and talking to ppl all over new england area.
But we have hardly been able to get a convincing number of ppl to attend the rally.
Have you watched the bus thread for New England Area. 26 votes, can you believe that.
We definitely need to get more innovative. I dont know what ppl want, so they can be motivated.
Sometimes i think being educated is a curse, as ppl become more scared and are fine adapting to the system.
Look at the ILLEGALS at least they came out openly. They dared to come forward and i am sure they will be rewarded sooner.
LEGAL ppl who have nothing to fear are then also they are more scared to do anything. So this is the right time for me to express my opinion LEGALS ARE FOOLS.

Anyone invoking AC21 with unapproved I-140?
If you try to use AC21 without an approved I-140 your employer can withdraw the I-140 petition ( since it is not approved yet ) . So best wait a few months until it is approved and then merrily go the AC21 way

You are the first guy who wrote a sensible post regarding CIR. Most if not all people here are delusional when it comes to CIR. I don’t trust Obama and Durbin to do any justice for Eb immigrants. The democrats agenda was always the illegals, as far as we EB are concerned they would prefer that we just get kicked out through endless RFE harassment from USCIS. The fact is republicans don’t like non whites to immigrate to US and the democrats are color blind to most extent but they are class conscious, they like illegals and poor people to immigrate to US because they can control them whereas they cannot control and herd the EB immigrants. So when the negotiations for CIR start Republicans will oppose any immigration so the democrats will strike a bargain with the republicans where they will ask for amnesty for illegals and in return they will happily throw the EB community under the bus by saying they are "reforming" the US immigration system by introducing a points based system where even existing applicants like the EB folks who have been in US for the last 10+ years have to re apply in points based nonsense system. Before people get angry ask yourself this question

You wait for 120 days and make umpteen calls to USCIS. Finally you get your EAD which is valid only for 10 months eventhough your priority date is predicted to be in next Ice Age.
If you want to correct the mistake done by USCIS go through some more pain and hassles or suck it and shell your hard earned money to renew after 10 months.I guess no one in USCIS cares for shoddy service they do.

I received an RFE from NSE on Sep 2nd week asking me to prove that I have 5 years of experience after completion of degree.
Country: India
Date of Joining with current employer : Jan 2006.
PERM Filing/ Approval Date: Aug 2006.
I-485/ EAD filing Date: July 2007.
I-140 RFE received date: Sep 2007.
The RFE reads as follows.

"Please submit evidence which establishes that the beneficiary had at least five years of experience as a software engineer after receiving his bachelor's degree but prior to August XX, 2006. Since your evidence does not indicate that the beneficiary received his bachelor's degree until 2002, this does not appear possible.
If the beneficiary received a degree prior to 2002, please submit a copy of that degree. A certificate that he had completed a coursework for a degree is not a degree."

I was hired by a software company in December 2000 and I have work experience ( as well as experience letter with 40 hours a week) as a software engineer from Dec 2000.
But now according to the RFE, INS is not ready to count that experience from Dec 2000. I finished my school in Dec 2000 and never had to go to the school except for one exam in 2001 and another one in June 2002. (In my university, examinations are conducted only once in 8 months). I checked my transcripts that were sent along with I-140 and it has the dates of 2001 and June 2002 due to the examination. Its present at the bottom along with Main date of Dec 2000.
I had placed the course completion certificate from my college along with the I-140 application and it looks like INS don't take that info consideration.
I am in deep trouble now. Your help is greatly appreciated. My attorney didn't find these issues before filing the labor certification on EB2.
The newspaper ad given before filing the labor certification asks for Bachelors degree and 5 years of experience.
Please help me by sharing your experience(s) as well as comments. I will really appreciate your time and effort.
My only concern is to save my labor certification so that I can keep my I-140. I read in some threads that INS gave an option to convert the case as EB3. Is there a way I can keep my EAD alive by those motions?

I don't think you get a sense of his problem, even though you claim you do...you are in fact beating a dead horse...I got your point regarding IV's efforts, and am not disputing that one bit, but at the same time when someone posts a valid concern/issue that they have, it doesn't hurt to have some empathy....I'm sure you wouldn't be too happy if you were in their place....

I am just confused that how they assigned 70K EB2 visas in 2008. Because EB2 share is
40k + 4k(EB1 left over)+? how many FB = 70k . So from above it looks like all FB leftover went to EB2.
Please clearify.

You can revnew your GC after an intial period of 10 years. You are at your free will and wish to remain on your GC. You will be eligible for Naturalization after 5 years. That does not mean that you have to use that oppurtunity.

Regarding the orignal topic, even I have never heard anyone not getting citizenship because of them leaving the GC employer. Personally, I won't wait for six months or even a single day, if I see a better opportunity.

Is this supposed to be cribbing, just for the heck of it? In what way can getting a 2 yr EAD be bad news?
For EB ROW, if they issue 1 yr EAD...does tht mean their 485s are not approved for at least 1 yr?
Received 2 year EAD card in email. Card is valid from jul 30th 2008 to jul 29th 2010. My PD is current.(May 06). Dont know if this is good news or bad news.

Just cut your losses and so much time that you have already spent on trying to salvage this I140.
Was in exactly the same position as you are now six years ago and had to start a new application.
I still do not have a green card due to the labor certification backlogs and visa number retrogression but at least have got an approved I140 and AOS in process.
My advice to you is, MOVE ON!
Spend your money on a new application with the correct wording in your adverts and in the more applicable category.

Since no one in America does much of anything in December I am planning to start trying with congressmans office in mid Jan. I have to do something and try - I cant keep sitting hands folded. Or they will say quota is over before we know it - remember ROW is at 2005.
That's true that Dates becoming current does not necessarily ensure that someone will work on your case. Writing to Ombudsman might help (but not necessarily). There is a simple form, Form DHS-7001, fill it and send to Ombudsman (address to send to is on the form - you can search for the form). They forward it to your Service Center for an answer within 45 days. If your dates remain current for this 45 day period, there is a chance that your Service Center will look at your case. If not, Service Center may just wait until your dates are retrogressed again and send a standard reply that you are not current.
Taking an InfoPass might initiate some action too.

If not, Service Center may just wait until your dates are retrogressed again and send a standard reply that you are not current.
Taking an InfoPass might initiate some action too.
