If you have current AP, you can travel while your AP renewal is pending. AP renewal will be from the date when your current AP expire.
In other discussions it is mentioned that if I-485 is pending & you are applying for renewal you don't need this letter.
BTW, i just read this in the I-131 instructions, so if i hold a valid AP now and apply for renewal and go to India and enter back using the existing AP, does it mean my pending I-131 renewal will be abondoned? :confused:

I think that the DOS (Dept of State) releases VISA Numbers on a quarterly basis. If that is the case, there should be movement in EB2 India in Jan 2007.
The other possibility always exists that the numbers were released for this quarter but the demand was SO HIGH that the net date did not move at all.

They are opening threads for FP Notice etc - they are not looking backwards at us - What are you planning to do ?
- My lawyer wants to refile (with no addional lawyer fees). Does it make any sense to re-file?

I am already using my EB3 EAD to work (I invoked AC21 last year to change job) Can I know how much it costs to file EB2 labor+I-140+interfile process , if my current employer says that I have to pay for it myself (I was given this offer because I told them I did not need sponsorship and I had EAD).
By law Employer is required to pay for your labor. You cannot pay for your labor application. Employer can ask you to pay for your I140 which cost around 400 but if you go for premium processing you can pay 1000 extra. There is no other cost involved. To port your date your lawyer sends a letter to USCIS requesting them to consider your EB2 I140 instead of your Eb3 140 which results in your successfuly porting with your priority date still being maintained from old labor

The bill states failing to show evidence of your immigrant status, is a misdemeanor and will result an arrest. So this is going to trouble a lot legal residents to prove they are legal and there will be a lot of litigation as a result of this.
See how Mr. Blog feed has omitted the fact that this law is against "unauthorized alien". To a casual observer it would appear that IV supports such endeavors (promoting illegal immigration).

only reason USCIS can afford to do it is becoz they are not accountable (As we are not a vote bank)...
But with IV on our side, we can make them streamline their procedures and work efficiently - whcih has never been a priority.

I think u r in a trap here. I recently talked to a HR of a desi company and he clearly told me his boss does not want to file for 485 for all eligible applicants and is working on strategies to fool his employees into prolonging things till dates retrogress.
U can choose ur lawyer, u don't have to let employer know u applying for 485 at all. Do not link ur lawyer and employer for any reason. Keep them both away. U already have 140 approved and u have nothing to lose.

Sats123, Chanduv23 is correct, also reading that with the paystubs you can avoid the employer letter saying that you work in such position and for such salary, finding out what position they used to file your labor (did you find it in the database on my previous post) and considering that you are about to get ripped off, it would be advisable that you go through that lawyer that someone was saying charges 1000 to file your papers and 500 for your spouse;
Did you get the medicals? I know it takes time now to get an appointment, and if you want to file the I-485 on your own, please ask if you have questions, I think you can get out of this trap and before the immigration rates hike on July 30th.

I am getting confused here about digital photo and USCIS not accepting them. I am assuming that "digital photo" just means pictures taken from a digital camera and printed out, which is what most of the studios do anyways, so why would USCIS have any problem with it. Is there a difference in pictures taken from a digital camera vs poloroid camera? If anything, digital camera most likey will have far better picture quality than poloroid camera so what's the deal with "digital photo" being unacceptable. Or do you guys mean a photo on a floppy of something when you say digital photo.

Hi all,
Mine is a different situation, i was with my employer till mid of last year and did not inform him while leaving his company and joined another job (h1 transfer) he is now saying that the vendor did not pay him some money and i have to pay that amount and he is demanding that amount for my W-2.
He also said that he would take legal action if i didnot pay his losses ( i did not sign any document with him other than my h1b papers) no agreements,
I am going to call IRS after feb15, but is he going to go to court?
Please suggest me.

Did you not give him any notice at all? When did he find out that you were no longer working for him?

This is relevant because some of us have EAD which is legal authorization to work (restricted though) or spouses have EADs (unrestricted). Placing barriers like US citizens only or Greencard holders only is discriminatory.

dear members,
dint had much time to go thro' your responses. but if senior ppl are targetting this fellow( mercies) for this thread, then i beg to differ. because as a member of IV, i have been answering "hadron" posts too at immigration portal.
I think all Mercies is trying to do is help IV out, by preparing answers of such questions which stupid ppl ask, so they can be put to a stop right away. Probably he's drawing your attention to some q's that all of you have answers for, just guide mercies to that post,
but i think all of your remarks have been directed towards merices only as if he's started it all.
i guess we outta stop ppl who are trying to defame this collective effort by giving them one-point answers.

You're right, the point I was making is the real intention of these Senators...When you want to scr.ew somebody you ask questions that are hard and mostly unanswerable....Take this example, Look at the requirement that Hyderabad Consulate has put up for H1B Visa Stamping, it sounds like they are saying don't you dare!!!

Yes; some people are not going to change their minds no matter what. I'm sure Grassley gets a lot of contributions and support from like minded people and he has to toe their line or they turn on him.
The other real American way would be to look at ways of undermining Grassley.
Case in point was Elliot Spitzer. Although what he was doing was right and justified; he took on some big players in Wall Street. Lots of fines; regulations, etc. Then all of a sudden he gets caught in a sting and he is ruined forever.

We don't even advocate for anything, just post things on the forum. IV has given us immigrants a platform - many of us don't even know it, let alone using it.
If we want to stay in this country, we need a president who can take this country progressively to the future instead of "lets take the country back" "this is not the country I grew up in" rhetoric! If this country goes backwards in time while the rest of the world embraces progress - guess what? - No use having a GC here.
