The problem really was that IOs are not properly briefed on AC21. There are some cases where they have to ask their supervisors about it. What if the supervisors are also not familiar with AC21?
As others are saying, IOs will soon gain more knowledge on AC21 as many will use it due to the retrogression. Until that time, it is risky.

I am now worried that eventually we will all get the GC and then we will sit out for 5-7 years and get a citizenship... Then make a trip to india only to realize that the the world has shifted.
Then it is all back to square 1, H1, GC, citizenship in India.... :D

Complaint to USCIS...I know of one such body shopper who did the same thing...sold one labor to 10 people...when the fraud was caught...the employer was arresetd and the remaining 9 people who bought the labor were deported out of US...u should get the labor bak in ur name....fight for it...if you think this may bring ur downfall....take down ur employer with u...

I know before you start blaming me for this thread, as it is of no use, I would like to point out that most of you must be experiencing the same thing. I didn't care much for Visa bulletin until it became current for EB2 two weeks back. As the time progress, I am doing all sorts of things, like checking USCIS case status, and checking everything that can possibly give me some information. I know that it is waste of time, I know it is not good for health, I know that I will get GC when time comes, but still, my mind is tricking me to think about it. I checked all these forums until 2A.M last night. I am not having enough sleep. I am waiting for a opportunity to get rid of my desi employer. I am really getting frustrated (I am not saying that I have been waiting for GC approval desperately). I just want to share my frustration and what I have been going through. I know I am in a better position than most of other people whose priority date is not even current. I wish they never dangled a carrot in front of me. I am not sure if they disappoint me next month, but I am still keeping my hopes. Hopefully, I would get over this and have enough sleep from today.
I met a guy yesterday who applied for GC in 1998. EB3-I. Has not got his GC yet. You would expect him to feel worse than what you feel. But he was completely relaxed. Reason, he does not expect his GC anymore.
Be happy that your PD is going to be current. But remove any expectation. If you get the GC, enjoy and party. If you do not, you will get it soon sometime later. Once the expectation of something is out, you will suffer less.

You can join our group and throw this idea, if 15 other in the group agree to it, it will fly...Atleast guys come forward to do something, what we should do we'll decide...Instead of asking for removing, perhaps asking for making it in ratio of country sizes might be more palatable. Note that Nepal has same numeric quota as China. I don't know how you can influence or initiate such changes, though.

I Still Believe in USCIS for the GC and the H1B Processing for giving me a fair chance to particpate, eventhough its a Lottery ( more or less like that for GC Processing also, although its not an "official" thing), because if GC was processed from India, i know that half of the people will come with an MP's, and MLA's recommentation, another group will come with distant relatives in USCIS( to approve their cases faster) and another group would bribe the officials to get it. Poor people like me who dosent have any of these will wait for a GC or H1B forever. Its only because in US when we stand in a Queue or line, we see the FIFO, we expect the same from USCIS also

I now realize with the backlog and the H1B that things are worse out here. GC process is such a long and arduous process that it takes the most productive years of your life away by forcing to work in a company without a change in position. H1B has now become even more of a laughing stock because of the mega lotto we have every year and everyone could see this coming 100 miles away and pity that nothing was done for last 2 years to address this problem

off late we have been getting a steady stream of good news, updates , changes mostly to our favor.
It is not because someone in govt thought of giving us a break (if they did then I say give him/her a promotion/ merit increase what ever)....
It IS because people just like YOU fought for it....

Their way of getting here may be illegal but when the amnesty is passed every so many years and they are allowed to just adjust their status with no questions asked, they are getting their GC as legally as it can get. They also get their GC only after it's legal to do so. They don't go and print one. They get it legally.
Again, it's the system/law that let's them do that. It's perfectly legal but they are cutting in line and that's where the problem is.

as far as I can tell, gmatch is not doing anything ILLEGAL. as for the practice being FAIR or NOT, that is a separate discussion.

Customer service opened SR and sent to local office. Got letter from DHS (3 weeks back)that they researched case and are actively processing it, also if I dont get any correspondence with in 180 days contact them.
Till date I did not get any letter saying that case has opened. Will it help if I take Infopass and go to local office. Please advice.

For me, my AP was approved (along with my wife and daughter) on Oct 1st 2006. My Notice date is Sept 10th. The LUD on AP was 10/04, which said that the approval was "mailed" on 10/02. Hwoever I recd it on 10/20 and I could see that it was mailed on 10/19 from USCIS office. So, atleast for APs, even the status shows that it's been approved and mailed as well, it seems that it's not the case. It's been taking couple of weeks to get them in hand. Hopefully this info helps some people who are still waiting for APs.
I also took an Infopass appt, as we didn't recv FP notices yet. I opened a SR, but nothing so far. It looks that I may not get before I go to infopass next week.

I just posted this in another thread.
I saw the show yesterday. It is very sad that people like lou dobbs are twisting the facts by saying around 700,000 H1b visa holders are overstaying in USA. Also on that show one senator named "TOM" forgot his lastname, is saying the same and also that guy even did not know how long H1B is valid, he says it is valid for 5 years after that H1b visa holder become illegal. These kind of people spread hatered among common people against immigrants. is there way, we can sue these guys for their racist remarks/ misleadeing information?

I have already complained to State DOL since last 3 months and still their is no movement...i heard from one of my fellow employee at the precious employer that the guy received notice from DOL immediately but dont know what he did after that....and now he seems that he is closing down his company becoz most of people have left owing to his unethical pratices....he doesnt provides health insurance despite mentioning , says that leaves can be encahes only after a year..
and now cooking a new story for rather than sending the w2 , telling that u should receive notice for 25 k from his lawyer....
in india there is a proverb "ulta chor kotwaal ko daante" which exactly is the scenario ......

Finally after repeated expedite requests, SR, etc, I just received a call from my local congressman that NSC mentioned to them that AP renewal has been approved. I just saw a LUD update yesterday and today in my and my spouse's AP online case status. Its still sitting in initial review only. Hopefully it will show me approved in a day or two. Local congressman told that they will keep my case open until I call back and let them know its approved. Hoping to see an approval soon, will keep you all updated.

I wish some group were working on getting attached in some bill a provision that lets the H-4s work. I thought we had a good chance because it is under discussion a bill similar to Bill S.2611 that would let the spouses of the Illegal workers regularized under Blue card status to also work so I assumed that a some point they were going to have a provision for the spouses of H-1Bs. I hope IV and QGA are doing something about this. If no group brings to the senators etc.'s attention that there is a part unattended regading the H-1B spouses right to work, nothing would happen. Here is what I am trying to say:
If S.2611 is going to be discussed in the senate/house, this will allow the spouse of the Blue card status worker (previously illegal worker and now regularized) to work for any employer -while the spouse is in blue card status-, shouldn't it be mentioned in the same law in the parragraph with the H-1B and dependandts provision that that the same applies for the H-1B spouses -that they could work for any employer while the H-1B status of the spouse is valid-? The L-1 spouses can work too so why do we H-4s have to suffer? Why nobody is advocating this?

(iii) is convicted of a single misdemeanor for which the actual sentence served is 6 months or longer.

(iii) EMPLOYMENT- The spouse of an alien granted blue card status may apply to the Secretary for a work permit to authorize such spouse to engage in any lawful employment in the United States while such alien maintains blue card status.
(C) GROUNDS FOR DENIAL OF ADJUSTMENT OF STATUS AND REMOVAL- The Secretary may deny an alien spouse or child adjustment of status under subparagraph (A) and may remove such spouse or child under section 240 of the Immigration and Nationality Act (8 U.S.C. 1229a) if the spouse or child--
(i) commits an act that makes the alien spouse or child inadmissible to the United States under section 212 of such Act (8 U.S.C. 1182), except as provided under subsection (e)(2);
(ii) is convicted of a felony or 3 or more misdemeanors committed in the United States; or
(iii) is convicted of a single misdemeanor for which the actual sentence served is 6 months or longer.

According to my spouse, there were three treatments at the embassy:
Passports retained for approvable/approved cases
Passports returned for rejected cases
Passports retained (no options provided to applicants) for audit cases
In your case, evidently they gave you an option as to whether you wanted to go with the delay. Am I right in assuming that?
Or were you asked to wait with your passport till they cleared up your case at their end?
We are not withdrawing our H1B application that was approved by USCIS. We are merely contemplating withdrawing from getting the actual visa stamp because of the uncertainty.
Right now, the embassy people are not being communicative at all. They did not respond to the last email we sent them and they do not have a live person taking any phone calls.
Initially they said the audit could take 4 weeks but their website (login enabled) says it might take up to 8 weeks.
The officer only said "you will hear from us when we get the clearance."
Said nothing about keeping the passport.
