I know Writ of mandamus cases are common for FBI name check delays.
What about AC 21?
When USCIS ignored AC 21 and denied I-485, did anyone file for Writ of Mandamus?

The H1-B per se does not require any job experience, provided the educational qualification is exactly what the job requires. To quote, "For an H1B for a programmer, for example, a candidate must possess the required degree in the field of computer science, electrical engineering, electronics, or a related field." When the candidate has a degree in an unrelated field, the employer would usually need to prove that the candidate has work experience in the field in which the H1 is being sought.

Well, I work for a home builder. Mechanics liens have become very common these days. Please make sure that you have an attorney who can really go through all the paper work. Its very important in such a very volatile home building industry. The title company can run a title search or a lien search on the property to make sure that there are no liens on the property at the time of closing.
Be Careful now than sorry later. If they lien your home even the law cannot help you!

Not really. If you see the late June submitters thread, many of us who applied in the June 20th timeframe have got their receipts. It took us 5 weeks to get the receipts from the date of filing.

The LCA process is the same for every state, under the new iCert LCA system. Approval can take 2 weeks, or longer if DOL does not recognize the EIN, which is very common.

hi,
i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.
(a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
if AoS is pending, then its valid till the AoS case is decided?
(b) If the validity is 1 year, what is the process for extending the I94 validity?

Sorry, I could not locate the thread about address change. I am moving at the end of this month to a new address in a neighboring suburb. I have an approved I-140 and a pending I-485 with AP and EAD in hand.

Is filling an online AR-11 sufficient? Does this update our I-485 and other pending/approved applications automatically. Please advise.

H-1B visas are work visas that allow foreign nationals to temporarily work in the United States for a U.S. employer. A U.S. employer may petition a foreign national under the H-1B classification which specifically applies to individuals in a “specialty occupation." A specialty occupation has three requirements. First, an individual must have a bachelor’s degree or higher degree or its equivalent for the particular position. Second, the degree must be common in the industry among similar organizations. The beginning of the fiscal year for 2010 is October 1, 2009. Employers may begin filing their petitions six months prior to the start date of employment but the individuals cannot start their jobs until October 1.
It is vital for those individuals wishing to work in the United States to begin preparing their H-1B paperwork before the cap is reached. As of August 7, 2009, approximately 44,900 H-1B cap-subject petitions had been received by U.S. Citizenship and Immigration Services (USCIS) and counted towards the cap. Please call us at 214-999-9999 if you would like to begin the H-1B process. The H-1B cap-subject count is available at the USCIS Web site (http://www.uscis.gov).

USCIS might re-start PP for I-140 once they complete receipting 485 applications and EAD, AP approvals for July and August filers..which may take atleast 3 to 4 more months!!
