Dude nothing will happen, this was lost and last battle.
The problem is us, yes "us". Most of us come to check whats on the website and then make sure we stay abreast with it. No one wants to work etc mile except making stupid phone calls and sending faxes.

We need the IV core team and the administrator to guide some big rally's. Guys nothing will happen until we are bold about our intentions.
I noticed everyone comes up with their different ideas, but no one works to implement it. We need to stand together and do something big, when was the last time we had a big rally?
And how many people actually showed up? Desi's wants everything fast and free.

All new members need to take a more active role in order to succeed and continue this effort for a long time for future immigrants.
I do not think having an EAD is a cause of inaction. It is more about having confidence in the effort that their effort will truly help them and everyone else like them. They can get confidence only when they get involved and get in the thick of things and see for themselves how things work. I have heard people calling USCIS every other day finding their status if they just get an LUD. People take infopass just to find out their name check status. So why can't these people make calls to lawmakers and take an appointment to meet their lawmakers.
Until some time back people were by and large afraid to even write to lawmaker offices. But when their case was stuck in namechecks, they wrote to everyone including WH. So why cant we write letters during an action item? We need to think like a community and not as an individual in need of a greencard. An individual cannot achieve anything alone but a voice of thousands can do a lot.
We should feel happy that there is an immigration voice that is a voice of this community. It is not a lawyer forum created for a lawyer's publicity or a forum managed by any business interest to make profit off this community. The aim here is to get people relief from their immigration problems and IV resources are utilized for the community. People need to adopt IV as their place to go for all immigration related discussions and data from IV tracker and visit this site more often and try to get involved. Remember that just by visiting this site frequently, you are helping this effort in some ways.
Until IV was there, people were scared to post freely about employers, lawyers, USCIS, lawmakers etc. People were not willing to come out in the open with their real names for some unknown fear. But when Immigration voice came, everyone starting gaining confidence and did not have any fear. You can see that from the kind of posts we see these days on the forums. Such posts never existed 2 years ago.
This in itself is an achievement for immigration voice and this community. We have generated so much awareness about this cause that never existed few years ago. Legal immigration was only about H1B quota. After the sucess of July I485 filings last year we were able to get the 2 year EAD rule this year due to the admin fixes campaign . So let us not measure our successes and failture with a bill. There is a lot else we have acheived in the last couple of years.
We can look forward to a lot more if we all continue to work positively and involve more people in this effort and on this website.

In case anybody noticed, the GREATEST friend of EB community, Senator Durbin is now the acting Chair of the Senate Judiciary Committee. In the absense of Sen. Kennedy, our GREATEST FRIEND is going to bat for us. Its going to be Great and we will see Recapture be the first bill pass in 111th congress. Congrats everyone, the GREAT participation of over a million "highly educated" "highly informed" immigrants will now be rewarded.

I dont think so. I believe that EB3 I would get the bare minimum they should get in a year if not more.
I am not tracking approvals rate as such. But if, CIS hasn't used as many numbers have DOS reported, then as Ron suggested, dates will move forward for EB3 Ind.

According to the AILA, approximately 40,000 visas remain in all employment-based categories, other than EW, for FY2007, according to its sources, and that the USCIS has far more than 40,000 adjustment applications in the backlog queue that are ready for approval, not to mention the additional numbers which will be consumed in concular immigrant visa processing. It is thus possible that the cap may reach within a short period in July, even though no one can predict it until after July 2, 2007. The USCIS at this time does not have any policy announced with reference to July 2007 I-485 filings which are filed after certain date in July when the total number is exhausted. However, considering the fact that the USCIS currently rejects the "Other Worker" category I-485 applications even though June 2007 Visa Bulletin show current for certain applicants because the "other worker" category quota was exhausted on June 5, 2007. This raises a serious concern because as we reported earlier today, the USCIS appears to be picking up the speed of processing of backlog I-485 applications in anticipation of flood of July 485 applications. The USCIS hands may be tied, should the EB visa numbers for FY 2007 is exhausted before the end of July.
The situation is particularly critical because of the USCIS decision not to accept the I-485 filings without the medical report. AILA demanded leniency but the USCIS reportely refused to accept such demand. Since medical report is "initial evidence" to I-485 filing, under the recent rule change, any I-485 filing with the medical report can be rejected or denied. Reports indicate that there are a huge backlog in scheduling medical examination in most of the areas in the country.

- How has greencard changed your life after receiving it?
GC arrival does change the life little bit. My frequent anxiety regarding various renewals like EAD, AP, H1/H4 vanished along with the tons of documentation that I have to do for those. I was struck to my current job during this process and continued the same way even after GC, but I am about change that soon. GC now provides me the ability to compete with others in the open market and provide me the confidence.
- What did you do on the day you received it?
I just went to the Temple and thank God for finally receiving it during my life time!
- How did the long wait upset your life?
More than me, it upsets my wife a lot. This does take a toll on her as she is confined to home and occasional voluntary services. She is now vigorously pursuing for a job in this down market and finding it difficult to compete with others, who have recent US job experience.
- How did immigrationvoice help you during this long wait?
IV helped to be better informed about various processes, procedures. This also helped me to deal with the attorneys directly by-passing the paralegals, who have little knowledge and to get the attorney�s much needed attention to my cases.
- Would you like to continue your support to immigration voice and help others waiting?
Yes. I do visit the forum from time to time and provide my experience and get updated with the changing rules, regulations and the visa status.
- Any advice for everyone?
As we are the people in no man�s land, I would suggest every one to be united to support the noble and good cause to revamp this system. I was driven away by the infighting and bickering and do not understand what benefits that is going to provide. Though I understand the pain, frustration and agony for the uncertain wait for this process, I would like to remind everyone that this is the time where we may need to be more united and welcome others instead of fighting among ourselves.
Once anyone received his greencard, please update the IV tracker too. We like to see how many members in IV are greencard holders and what is the current trend of approvals in our membership

India rejected both Boeing and Lockheed Martin's proposal of fighters . I am not debating the reasons or the merits of this decision if this was right or wrong . I am just discussing the potential repercussions this has had so far and might have .

1) The issue is so serious that Tim Roemer , US Ambassador to India submitted his resignation immediately since he was on the hook for making this deal work .This shows the measure of disappointment they had.
2) India was seeking US assurances in security a Permanent Security council seat , which looks far fetched now .
4) Pentagon , Whitehouse and the DoD very upset that deal fell through . This sentiment will certainly percolate to the USCIS and the State department and might embolden Anti Immigration senators whose measures will get more support in the house and senate.
5) Prosecution of companies entangled in cases like Infosys might find more support and favor with the Govt.
Question is how/if there will be a backlash against India / Indian's get back at us at least in the short term .Increased scrutiny and visa denials , PoE Harassment , GC audits etc.
Will the US take a Tit-for-Tat reaction on this issue is what remains to be seen.
Disclaimer: I am just someone who once seriously considered getting a degree in Strategic Studies. I am not from India. If you don't like what I have to say or feel that it is not my *place* to say it, just ignore me. I will not get engaged in an online wrestling match to demonstrate my "e-toughness".
It will not have any major repercussions b/w the 2 countries or any impact on the Green Card situation. Relations b/w US and India encompass a much broader spectrum than just a large defense contract. India's economy presents enormous opportunities for US companies, there is the issue of countering China and not to mention the same view on most regional as well as international security issues. They will not get any where if they start slugging it out every time there is a lost trade deal. India has helped US in the past with Iran's nuclear program while US has shown the importance it gives India by pushing an exception from NSG in nuclear energy.
If anything I am surprised that US is surprised that they lost the bid. Both Rafael and the Typhoon are amazing platforms. I did not read the actual RFP but it is arrogance to assume that the US offerings were inherently any better than the European offerings.
@kumara121: I can assure you that Uncle Sam does not want to "..come and check the planes whenever and wherever it wanted to". If I only had a dollar for every conspiracy theory I hear from people from our part of the world (Pakistan, Indian, Bangladesh) I would have been in Eb-5 years ago :)
The biggest issue was that the US offerings were very comparable to existing Mirage 2000 platform that IAF already has. The MRCA is a long term upgrade and does not make sense to get a plane that is so close to the existing inventory.
Bottom line? The GC aspirants did not gain or loose anything. IAF won by getting a hot fighter, the only loosers are Boeing and Lockhead.

2002 asylum case was denied, we had to go back to our country (we didn't stay illegaly)

2006 My daughter turned 21 - She had to change status to F-1 (of course college fees were triple). She is out of LC process because of her age.

First of all, not everyone here is from India. Second, not everyone here is from programming/IT background. It is easy to make that assumption, but believe me, there are plenty of non-indians, or non-IT people, and even non-Indian, non-IT people here. :D
For these, what is or is not happening in Bangalore is completely irrelevant.
Second, people who are still here have already decided where they want to be. (Which is why they are on the forum in the first place). People change countries for more reasons than just following the next IT boom.

To give a simple example, our company is looking for people in Australia, Denmark, Finland, Canada and UK since the pool of qualified people in India has dried up in our field. Can anyone guess where is the biggest talent pool? Nope, not in Bangalore, its right here in USA!! Not all companies are looking for the cheapest person. They are looking for the best person. And in many cases, the best person is already here, and has gathered more experience over the years working for US companies. But they cannot hire her, simply because she is on a visa and thereby beholden to another company. If she had a GC, that would free up the talent pool and thereby make many companies less reliant on H1Bs. Increasing GCs for EB candidates has the same effect as increasing H1 quota, with the added benefit of making the cream of the crop available and reducing the uncertainty and hassle of hiring an H1.
When you outsource, you lose this talent pool which is already sitting in your backyard. You may still outsource, of course, but the most cost effective solution would be to hire the top talent already here. This is especially true in professions which do not work very well in outsourced situations, like business consulting, marketing, management etc.
This is why it is in the best interest of companies to support EB GCs.
Pineapple .. you hit the nail right on the head. It is a misconception that everything is cool in India. There are a lot more problems than just your salary. Money is not everything . I think standard of living and less corruption , cleanliness and less crowd do count towards life.
For these, what is or is not happening in Bangalore is completely irrelevant.
Second, people who are still here have already decided where they want to be. (Which is why they are on the forum in the first place). People change countries for more reasons than just following the next IT boom.

Here comes one more preacher. Most people on this forum are no saint, they not even a man (or woman) enough to stand up for themselves.
Please don't comment about anybody's else abilities without knowing him/her. You don't know me or what I have done. Then how can you comment that "not every man enough to stand up for themselves."

We are a Union and thats how a union works that is actively supporting the cause of its members.
You don't understand what does WE and UNION means and how to co-operate. I bet you must have issues with your co-workers also in work (if you work).

If one is stupid enough not to understand that we are trying to help everyone and thus this "one help" need to be demanded then god help that person.
I don't need to justify my abilities or whether I can stand for myself or not, but the only reason I replied to this thread as I can't resist my self by seeing comments by people like you here.
I believe in GOD very much and I believe that GOD does justice in HIS own way which most of the times we don't undersatnd. In short, I have seen very few unlucky people who are still in the process of GC with 8 years (like you). May be because of your traits this has happened to you. GOD's justice. May be you need to hear your inner voice and understand that don't hurt others feeling and don't need to go to DC or join IV.
Understood, we all may have problems but those could be solved with whatever our share of work we can do to support this cause.
