I just opened a session in IV asking for experience and knowhow which seems to have turned into a heated congress session.
Plassey, regarding your thoughts and comments let me tell you something "GC is not the best thing in the world, for which one has to be so depressed and cry in bathroom". In fact, I got laid off recently, my LC gone, which was filed on Sep,2004. I am looking for job again on my 8th year H1B extension. In this uncertain future it is better to return home for me.
I was in similar situation last year, I got layed off after working for 5 years in same company and was on my 6th year h1b with eb3 L/C pending in BEC. I switched to consulting immediately and got extension based on the old L/C and applied for new GC.
These are situations that are not under our control. We must live with these FOL

amitjoey, Thanks. I have sent a request to my senator yesterday and also mailed them all the copies of the documents. Just hoping that will also help. I was told that my file is already assigned to an IO and you will soon hear from USCIS. "Soon" in USCIS dictionary seems to be 30 to 45 days and thats very scary s that means it will about 130 days. I am just hoping they will approve soon. After approving it seems they are taking additonal 30 days to print the card.

Congratulation...
I hate to see you leaving, you need to fight for others. Who knows somebody close to you might get stuck in this mess. IF everybody leave just because they got what they need than its not fair. If you think IV has helped you in any way then each of us put some effort to help IV and its members.

EMPLOYMENT: Demand for numbers in the Employment Third �Other Workers� category, as well as the China and India Employment Second preference categories, has been escalating. No movement in those cut-off dates will be possible until the current level of demand subsides.
Translated that means, the Tsunami of 245i and Backlog labours is hitting, there can be no movement until this improves.
In other words, absent legislative action to allow more visas, you are lucky if dates do not retrogress.
We should stop following bulletins and focus more on lobbying.

I dont believe Indian govt can help in this...Lets first gather people and we will let you know the next course of action. There are bunch of people in Face book who got struck up in visa delays. I am trying to reach out to them. Its big group...try to get them here. Please contact those people...

IV hadle of Dr Saurabh is 'drsaurabhsethi'. abhijitp, you guys rocked the stage with my favourite music. I want congratulate everyone in CA chpater for their enthusiasm and grand participation in the rally. You guys did it, what we couldn't do being local to DC. We learned a lot from CA chpater memebers from their dedication and hard work. Keep it up. Hats off to all CA members.
I want to add that it was only because of the superb guitaring by Dr Saurabh that we could do the song in the right (soul) rhythm. In my own youtube video I had played a much simpler 4 count rhythm as otherwise it was getting kind of hard to focus on the lyrics.
Also, I don't know how others from North CA feel but Aman's motivating speech during his visit to CA (the Milpitas event) was the turning point for me! Maybe before the next rally, Aman should consider visiting all 50 states:)

I left my previous employer more than 6 months back , he didnt paid me my final paycheck and i complained to DOL since 3 months...now wehn i asked for my W2 he said me to do whatever i feel and he is adamant at not giving it....moreover he said that his company has suffered losses worth 25K and his lawyer has sent a legal notice in this regard....and when i said how will we file taxes he says he wished for me to be out of status and go back.....
Since i have complained to DOL and also it is more than 6 moths since i left his organisation giving proper notice and have email confirmations, can he issue me legeal notice.....?please advice...
He is also saying that he has written to USCIS that I am fraud,....though I have been working in fortune 100 companies and now also working in reputed company and never lied for anything and was on project from day 1 since I came to States....? can USCIS cause problems for me in future...
Also, he seems to have closed his company..
Folks please advice....
Keep all email correspondences....You can infact make him pay dearly for harasement...

I guess most of the folks here are busy preparing to apply for 485. I have different problem here.
My employer's attorney is charging me outrageous fees of around $5000 to
apply for 485, AP and EAD for me and my spouse. This excludes USCIS fees. I work on hourly basis, so I should be taking care of immigration fees. My employer is not allowing me to file through another law firm.
Do I have any other options. How much do they charge usually.
Get a approval notice for I-140 and file I-485 urself, if I-140 not approved then get the receipt number and file urself

So if you ask me today, would I rather have filed 485 with a PD of 2006/7 or be in your situation, as bleak as your situation looks today, the better choice might be your situation.

Well that depends on lots of things. If your assumption is that the PD is gonna move slowly and gradually forward, then what you are saying is true. Again, once he/she files 485, his 485 is not going to be processed immediately. AP, EAD may be issued but it may take 6-9 months for 485 to get processed.
However, if PD moves so much ahead that your PD is also current, then you will get your GC (if other processes are complete) whereas he/she would have just filed 485.
