What will be the basis for emergency appointment ? I was strictly warned not to mention AOS as the basis for the request as it can seriously harm.
I just checked the Mumbai consulate website (I am assuming your wife is in India) and the earliest available appoitment for H4 is July 27th. Why cant she take that? All you have to do is reschedule.
There are also appointments for H4 for Aug 3,6,8,10. She shoudl reschedule her appointment.

this could be read 2 ways...either you need have an approved I-140 prior to filing for portability OR the adjudicator needs to approve the I-140 prior to determining portability.
You can read it 10 ways, but the CIS has only one interpretation(see bold below).
An un-adjudicated Form I-140 petition is not made valid merely through the act of filing the petition with USCIS or through the passage of 180 days. Rather, the petition must have been filed on behalf of an alien who was entitled to the employment-based classification at the time that the petition was filed, and therefore must be approved prior to a favorable determination of a �106(c) AC21 portability request.

Same here, fraud bodyshop consultants make life miserable for genuine applicants and also give a bad name to the H1B process. It's more like an easy ticket to come to the US as opposed to being qualified for a job. I wonder what people think , that life gets better once you start with fraud??

Great news! I was never on H4 so it does not really affect me. But any good news for skilled immigration is good news.

as per the info u provided u'r...... mail dt is 8/17/07 & receipt dt is 9/26/07...... did u'r application reach cis after july visa bulletin..... if yes, then it appears that with u'r april-06 dt. the priority dt was not current when they received u'r app .... is that a possibility.....

I think all depends on how many ROW cases are in the 47000. Especially older PDs, newer PDs most likely will be still in the I-140 queue or I-485 queue to be proceesed.
I presume that ROW would be significantly impacted by this as India & China would not benefit a lot from it now because of PDs being badly retrogressed. I'm afraid that this has the potential of exhausting EB3-ROW row numbers for the rest of the year. Am I wrong to assume this?

When you go for Fedex/USPS Express they takes your Name, Current Address in a page which has Pointer to the TRACKING NO. 1 copy comes to you , 1 copy goes out with Package and 1 Copy gets saved with FEDEX/USPS.
The 3rd copy above is sufficient to straightout any "Potential Liars" :mad:
Fedex Receipt shows Sender And Addressee, name, address etc. It does not tell whose application (and what else) is inside. In reality, having Fedex receipt only proves that some package has been been delivered at USCIS, but what is inside, there is no guarantee or proof.

lets stop this rhetoric on repubs, what about bobby jindal, marco rubio & nick haley and plz don't give explanations to distort the reality, many in the republicans sincerely support legal immigration, tell me few good things dems did to legal immigrants, aint regan the one who gave amnesty to illegals in 80s, aint bush the one who tried more than once to pass CIR, who opposed h1b fee increase recently?

We will know the veracity of their actions as more people report of their NC getting cleared over the next few months.
I think (1) in the statement made by USCIS refers to "DHS Secretary Chertoff indicated that USCIS and the FBI are changing parts of the name check process, with the expected result that a large proportion of the backlog should be cleared within six months" source: AILA Infonet

being on H4 for the past 4yrs scenario...?
what are the chances of the H1b approval being 4yrs on h4...? as in how strong is the resume being..?
will they question about the past 2 yrs of H1 status...asking cos I dint work for a while as I dint get a project..?
converting to H1 in such a situation, will this be risky and asking for trouble..?

Five reasons why I oppose immigration reform bill in its current form.
1. This bill in its current form does nothing to reduce the current backlog of employment based backlog of green cards. This bill infect reduces number of legal immigrant visas from 140000 to 90000 immediately for people who are waiting line legally and been paying taxes and contributing in fields of Computers , technology , pharmacy , nursing.
2. This bill makes things difficult/impossible of renewal of legal visas for me and my sister(both of us are on H1B).This bill changes renewal of H1B from three years to one year even if green card application is pending where as undocumented/illegal persons can renew their Z visa unlimited number of times even if they have no intention of applying for green card.
3. This bill puts more restrictions on H1B visa while awarding Z1 visa for undocumented /illegal persons with far less restrictions. Z1 visa can be self petitioned, they can work for any employer of their choice and job of their choice and they don’t even have to work as long as they go to school. H1B is far more restrictive, H1b visa holder is held hostage by employer and employer has to file the documentation for eligible candidate.
4. This bill does nothing to lift the per country allocation of green cards for legal/merit based applicants of green cards. If merit is the criteria for green card why should it matter what nation one comes from. Amazing thing about this bill is that if you are illegal and have a Z1 visa it does not matter what country you are from, NO COUNTRY BASED CAPS FOR UNDOCUMENTED/ILLEGALS (They are no more illegal because they have Z1 visa)while applying green card.
5. New merit based system that senate is planning to introduce is totally skewed towards illegal/undocumented people as well. Some of the key points, If you have a Z1 VISA(ILLEGAL/UNDOCUMENTED) and own a home you get some points in green card , If you are legally here and paying taxes and own a home you don’t get any points. If you have a Z1 VISA (ILLEGAL/UNDOCUMENTED) and have health insurance you get some points in green card, if you are legally waiting in line and have health insurance for whole family you don’t get any points. If you have Z1 visa (ILLEGAL/UNDOCUMENTED) and you have kids, Kids get Green card in 3 years. If you are legal and you have kids, Kids don’t get anything unless they become illegal and wait for next amnesty or legalization.
Please call your Senator and Congressman and let them know that this bill punishes people who are following rules while awarding undocumented people. This is not a letter from anti immigrant bigot who opposes every thing based upon talking points circulated. I did the same and got 2 more people to send them and I'm hoping for 2 more. We're a small office but any letter counts :)
