    Your first paragraph is wrong. If you are not working, then you are out of status. Regardless of whether your employer formally terminated employment and formally cancelled your H1B. Out of status means staying in USA legally, but not doing what you are supposed to be doing. If you dont attend classes and go to college when on student visa, you are out of status even though you are legally present.

    I am not convinced about this part. Do you have any link to some USCIS rule/document regarding this ?
    As per my understanding H1B employee becomes "out of status" when the employer-employee relationship cease to exist ( laid off )

    I travelled in last november thru hongkong. You dont need a transit visa but I felt humiliated with the treatment. Hope you know what I mean.

    And on another note My sis and her husband have been Bank Of America customers for a long time and they have decent amount of funds in their account .Their mortgage application was rejected by BOA because they dont have a GC only to be accepted by other lender and better APR on their loan :)

    I like this country and capitalism ...God bless America.

    Previously, the policy was that all worldwide numbers would fall down into worldwide third and then from there, fall across to the countries impacted by retrogression (i.e. India, China). The policy was recently clarified and today the unused numbers are allocated within the same preference classification.

    of course i would not vote for any preferential treatment of qualification over category.
    But in case certain people are heard of separately (example: folks with US education or prior experience qualifying them for a different category, as also the number of years they have paid taxes), it will only benefit the remaining.

    The Masters degree exemption / extra number of H1 visas actually do not overload the total number of visas available as an instance.

    I am assuming here that you referred Background Check done by future employer as a part of employment offer before granting you the final offer. In that case mostly your employer might have contracted that to third party. And if that would have been the case then it solely depends upon where you resides now and how many states you have moved so far from the date of first entry in uSA and what kind of new implementation all those states may have. Some states even gives "Red Flag" for traffic violation such as speeding. What happens is that, that third party would see only "red flag" and would not come to know about underlying cause of the "red flag". So as a process that third party first come to your future employer notifying about this " red flag". Then your employer decides to query that further having signature from you and would notify third party to dig further and then third party will go to state police to know the underlying cause and state police will work on that by taking fee and and some point of time it will say " hey he had traffic violation". So it may eat up 3 to 4 months to finish the whole cycle and ball is in your employer's court whether to hire you or wait to hire till then. Most companies hire without wasting time and afterwards if something really serious feedback comes in will boot you otherwise you will be fine.

    This is a real life example that happened a week ago. I was at the gym talking to a guy and he was asking where I was working. I told him and I got a look that suggested it was a crime for me to have a job.....No words exchanged but just the look of it...I could feel it..

    Same sense of entitlement to everything landed the US in the soup they are in right now?
    There are some very hard-working and bright people and I'm not generalizing here, but they need to understand the the foreign worker (who's probably being paid less than you to do the same job) is not the enemy. The unsustainable lifestyle is.

    U r covered under AC-21 if I-140 is not revoked by your previous employer.

    Be truthful to USCIS and using a very good attorney firm drat AC-21 and Employment verification letter to USCIS. Since your PD is current chances are after reviewing the new employment letter USCIS might approve your case.

    Please dont waste time in on this forum, instead spend some money to consult Rajeev Khanna or Sheela Murthy, it is worth spending every penny on the advice and their services for invoking AC-21.

    Per your RFE notice it looks like, USCIS is only interested in verifying your current employment in the similar profession. good employment verification letter and AC-21 draft is good to save your GC.

    RFE might have triggered due to previous H1B transfer, it has nothing to do with your employer revoking I-140. Trust me lot of desi consulting companies dont want to take any "Panga" with USCIS and 99% of the time they just ignore employees leaving them. So dont worry, dial in Murthy or Khanna consulting services and see what's their take on your case. If you are getting any help from new Employer's attorney that will be free of cost to you.

    Bottomline you need a competent attorney for answering this RFE and invoking AC-21.

    So now I just need to wait and see what exactly is asked in the RFE. Cant they send the damned thing by Fedex and bill me for it. Waiting for regular mail is painful. Here goes another weekend (sigh)

    I got an LUD on 8/14 on mine and my wifes I485s and also on the first EADs filed along with the 485. Anything cooking? I did change my employer in Feb 2010 and yet to file AC21. If any one had similar LUDs please post.

    I don�t know those folks you are comparing with me. I just said that IV opened a donor only post in wake of delayed April visa bulletin. I wonder why they did this as this was the time to educate/ inform all the members with whatever information they had (Now it is proved they had no info). This is not what a �non profit� organization or any organization would do in a time of uncertainty
    This is obvious that IV can not dictate either USCIS or DOL nor they had any information on April visa bulletin but they did not have to hide anything related to delayed visa bulletin fom the non paying members.
    IV is a great platform that bring together all of us under one umbrella so that we all share the information and make plans on how to make employee based immigration more hassle free.
    As far as is concerned yes I go there and my id there is same as here. I go there so that I could share my knowledge and experience and gather the same from other folks in the same boat as me and this is the same reason I visit IV.
    As far donation is concerned I donated once but after that I could not do it for my personal reasons. I will definitely donate once I am out of my crisis, but yes whenever, there has been any campaign initiated by IV of sending letters or faxes I have done my part sincerely.
    I don�t know why people like you think that is there enemy in fact they both are there for the same cause and can work together (I don�t know about any past clashes if any between and IV management)
    All I want is that IV be more informative to its members.
